Terms of Use

These Terms of Use ("Terms") govern your use of the .chabi iOS application ("the app"), developed and operated by the individual developer at support@arsik.org ("we", "our"). By downloading or using the app you agree to these Terms. If you do not agree, do not use the app.

1. Licence

Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable licence to use the app on Apple-branded devices you own or control, for your personal, non-commercial purposes.

You may not:

• copy, modify, or create derivative works of the app;
• reverse engineer, decompile, or disassemble the app;
• sell, sublicence, rent, or transfer the app or any rights in it;
• remove or alter any proprietary notices or labels.

2. Requirements

The app requires iOS 17 or later. Sync, sharing, and cloud backup features additionally require an active iCloud account signed in on your device. You are responsible for maintaining an adequate iCloud plan for your data.

3. Your content and data

You retain all rights to the content you create in the app (box details, item names, notes, photographs). By using the iCloud sync and sharing features, you grant the app permission to store and transmit that content through Apple's CloudKit infrastructure on your behalf.

You are solely responsible for the accuracy, legality, and appropriateness of content you enter or share. Do not use the app to store content that infringes third-party intellectual property rights or violates applicable law.

4. Sharing responsibility

The app's optional sharing feature allows you to invite other iCloud users to view and edit your inventory. You are responsible for whom you invite. Anyone you invite can read and modify your inventory data. Revoke access promptly if you no longer wish someone to have it.

5. Backup and data loss

While the app syncs data to iCloud, we do not guarantee data availability or integrity. We strongly recommend using the built-in Export feature to maintain offline backups, especially before significant changes or device transitions. We accept no liability for data loss arising from iCloud outages, device failure, accidental deletion, or software errors.

6. Disclaimer of warranties

The app is provided "as is" and "as available", without warranty of any kind. To the maximum extent permitted by applicable law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the app will be error-free, uninterrupted, or free of defects, or that any defects will be corrected.

7. Limitation of liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of profits, or loss of goodwill, arising out of or in connection with your use of or inability to use the app.

Our total liability to you for any claim arising out of or relating to these Terms or the app shall not exceed the amount you paid for the app (if any).

8. Privacy

Your use of the app is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Third-party services

The app uses Apple's iCloud and CloudKit services. Your use of those services is governed by Apple's terms and privacy policy. We are not responsible for Apple's services, their availability, or their terms.

10. Changes to the app and Terms

We may update the app or these Terms at any time. We will update the effective date above when Terms change. Material changes will be announced through an app update notice. Continued use after changes constitutes acceptance. We may also discontinue the app at any time without notice or liability.

11. Termination

These Terms remain in effect until terminated. Your rights under these Terms terminate automatically if you fail to comply with any provision. Upon termination you must cease using the app and delete all copies from your devices.

12. Governing law

These Terms are governed by the laws of Western Australia, Australia, without regard to its conflict-of-law provisions. Any disputes shall be subject to the exclusive jurisdiction of the courts of Western Australia.
